In January 2016, the United States Citizenship and Immigration Services (USCIS) announced a change in the fees for applying for immigration and naturalization benefits, through a final rule. This Monday 1is April 2024, the new ones come into force.
USCIS’ final rule sets new fees for individual filers at a maximum corresponding to the 26% increase in the Consumer Price Index since 2016, making most of these fees see smaller increases at 26%.
However, the rule keeps fee increases low for naturalization and adoption applications and petitions, also providing special discounts to nonprofit organizations and small employers among reporting employers.
According to the MC Law group, the final rule formalizes eligibility for existing fee waivers for low-income and vulnerable populations, expands fee waivers for certain humanitarian and other beneficiaries, and introduces a reduced fee option for certain individuals requesting naturalization.
Additionally, for forms allowing online filing, there is a $50 discount for those who choose online submission over paper filing.
Additionally, between April 1 and June 3, 2024, USCIS will accept the use of earlier versions of most forms.
The MC Law group indicates that during this window, submissions with previous or updated editions of certain forms will be accepted, filed with the correct fees. However, some new forms will not benefit from a grace period because they require an adjustment to the fee calculation. These include, but are not limited to, Form I-129 (Petition for Nonimmigrant Worker), Form I-129CW (Petition for CNMI Nonimmigrant Transient Worker Only), Form I-140 (Petition for Immigration for Foreign Workers), Form I-600A (Request for Early Processing of a Petition for an Orphan) and Form I-600 (Petition to Classify an Orphan as an Immediate Relative).
USCIS will use the postmark date of a filing to determine which version of the form and fees are correct, but will use the date of receipt for purposes of any regulatory or statutory filing deadline.
