P-to-P., March 30, 2024 [AlterPresse] — The election of the president of the Transitional Presidential Council should take place after the installation of the entity at the presidential palace, according to a draft decree relating to the creation, organization and functioning of the Council, consulted by AlterPresse .
The document provides that the members of the Presidential Council should proceed, after their installation, to the election of the president of the structure by a simple majority of the 7 voting members out of the 9 which constitute it (2 observers).
In the event of a tie, a second vote should be held, then, if it is still impossible to decide between the votes, the president would be drawn by lot from the two candidates in the running.
The criteria for being a candidate for the presidency of the Council are those established by the constitution. The person concerned should undertake not to be a candidate in the next elections, which will end the transition period, lasting 18 to 24 months. A deadline which cannot be extended under any circumstances.
Apart from the presidency of the Council, six sectoral cabinets would be formed and coordinated by the six other advisers responsible for six main areas: security, elections, constitutional reform, the sovereign national conference, economic recovery and social and humanitarian recovery.
Members of the Presidential Council should receive a “monthly allowance” from the public treasury upon their installation. “Unjustified privileges” should be removed and the use of service vehicles rationalized.
“Neither the wife or husband of a member of the Presidential Council, nor any member of his family benefits from a special status during the transition period, manages a public project, or has access to funds from the Public Treasury”, we read in the document. The status of “first lady” or “first man” is not recognized by the transition, he adds.
The choice of the prime minister who will lead the transitional government should be made following the same formula as for the Presidential Council.
Each sector constituting the Presidential Council should designate a prime minister. The choice of one of the (7 or 9) personalities would be made by absolute majority. After three rounds of voting, in the event of a persistent tie, the prime minister would be drawn.
The Presidential Council should not be able to terminate the functions of the head of government, unless the latter presents the resignation of the government, and, among other things, in the event of serious presumptions of criminal activity and corruption duly noted.
The main appointments at the various state institutions and public administration must be made by the Presidential Transitional Council.
He should appoint, by decree taken in the Council of Ministers, the commander-in-chief of the Armed Forces, the commander-in-chief of the Police, the ambassadors and consuls general, the directors general, the delegates and vice-delegates of the departments and districts , the councils of temporary agents of municipalities and municipal sections, as well as the boards of directors of autonomous organizations.
He should also appoint the nine-member Provisional Electoral Council, according to the criteria provided for in the constitution, a Steering Committee of the National Conference, a Commission for Constitutional Reform and a Truth and Justice Commission.
In the absence of parliament, the draft decree provides for the establishment of a body called the Government Action Control Body (Ocag). Its composition, role, missions and functions should be taken by decree of the Presidential Council.
The Presidential Council includes the voting members Edgard Leblanc Fils of the Collective of political parties of January 30, 2023, Leslie Voltaire of the Fanmi Lavalas political party, Louis Gérald Gilles of the agreement of December 21, 2022, Fritz Alphonse Jean of the Montana agreement, Laurent St Cyr from the private sector, Emmanuel Vertilaire from the Pitit Dessalines political party, who initially refused to be part of this structure.
