Hati-Justice: 30 certified magistrates and 12 others dismissed for lack of ethics, harassment of litigants and lack of moral integrity

P-au-P., February 21, 2024 [AlterPresse] — 30 magistrates were certified, 12 others not certified in particular for “lack of moral integrity, abuse of authority, extortion of litigants and lack of ethics” out of 60 files examined, according to the results of the magistrates’ certification operations , made public this week by the Superior Council of the Judicial Power (Cspj) [[1] and which the online agency AlterPresse became aware of.

The dean of the Côteaux civil court (South department), magistrate Gérald Exantus, is excluded “for deficient academic studies” according to the archives of the Jacmel Law School (ordinary session 1992).

The titular judge at the Saint Michel de l’Attalaye peace court (Artibonite department), magistrate Garbens Désir, much criticized, is dismissed for ransoming litigants.

The Cspj did not certify the judge and investigating judge at the civil court of Cap-Haitien (North department), magistrate Luc André, for “lack of ethics and absence of moral integrity”.

Most of the uncertified magistrates worked in peace courts.

Among the certified magistrates, eight magistrates are part of the civil courts and around twenty others are part of the peace courts.

Furthermore, 18 remaining magistrates’ files require further investigation, according to the minutes of the Technical Certification Commission (Ctc), sent to the de facto holder of the Ministry of Justice and Public Security (Mjsp), Emmelie Prophet Milce.

In separate notes, the National Network for the Defense of Human Rights (Rnddh) and the Bright eye foundation (Fjkl) had called on the judicial authorities to investigate and carry out judicial follow-ups on the files of 28 magistrates, most of them highly criticized and not certified in January 2023 for lack of moral integrity, among others, by the Cspjfollowing an extract from the minutes concerning the latest certification operations of magistrates, made public on Monday January 16, 2023.

In a memorandum dated Thursday February 23, 2023, the technical secretariat of the Superior Council of the Judicial Power (Cspj) urged all heads of courts to prohibit the 28 uncertified magistrates, since January 16, 2023, from taking their seats or exercising any function relating to the judiciary
