OCAG | Impasse: Will the Presidential Council follow in the footsteps of Ariel who categorically refused to set up the control body of the Executive?

The arrangements to set up the Executive control body provided for by the April 3 Agreement should have been taken immediately after the installation of the members of the Presidential Transitional Council (CPT). Some say even before the choice of the Prime Minister and the installation of the government.

This body also provided for in the December 21 Agreement which served as a pretext to keep Ariel Henry in power in Haiti for more than 30 months, was not put in place by the latter.

More than six weeks after its installation, the CPT, like Ariel Henry, seems not to be convinced of the importance of this control body called OCAG (Government Action Control Body) for the success of this transition.

No signal is sent by the CPT to announce the upcoming establishment of this third instance of the Transition (the other two being the CPT and the Government)

According to article 9 of the April 3 Agreement, the control body of the Executive must be constituted on the basis of broad consultations of the CPT with Haitian civil society organizations in the capital, the departments and the Diaspora .

Article 10 of the same Agreement provides that the Executive Control Body is composed of 15 members, chosen in accordance with the document “on the organization and functioning of the OCAG”, including two designated by the Diaspora, two by the organizations for the defense of the rights of women and young people, two for the West department and one for each other department.

The essential mission of the OCAG is to control the action of the government and to ensure the application of the Agreement, as far as it is concerned, and respect for the laws of ethics in the management of public affairs.

Imagine for a moment that this body was in place at the time of the choice of the Prime Minister, the formation of the government and the choice of the new Director General of the National Police of Haiti.

Many questions could have been answered satisfactorily. For example, the CPT, knowing that there is a Transition body (OCAG) which could hold it accountable, would take all precautions so that the process of choosing the Prime Minister and the Director General is as transparent as possible.

Another example: Prime Minister Conille would think twice before placing as Director of his cabinet (that is to say his right arm, a super minister) a former member of the previous government whom the CPT refused to integrate into the new government on the basis of a principle.

In short, for the good of the country, we must hope, as planned by the Agreement of April 3, that the Presidential Transitional Council does not plan to initiate all the important actions of this transition such as the formation of the CEP, the reforms necessary within the public administration and others before deciding to set up the Executive Control Body.

The CPT must publish as soon as possible the decree establishing, organization and functioning of the Executive Control Body which could have, among other responsibilities, the following:

Ensure the proper functioning of republican institutions Issue opinions on decrees, agreements and the national budget Give reasoned opinions on legal acts taken by the government Support the national dialogue process Ask about the implementation of government actions Organize information sessions with ministers on topics of interest.
