The Presidential Transitional Council announced the postponement of the entry into force of the new Penal Code and the Haitian Code of Criminal Procedure, according to a decree published in the official newspaper Le Moniteur, this Monday, June 24, 2024.
By this decree, the Transitional Presidential Council set a new date for the application of the decrees of March 11, 2020, which concern the new Penal Code and the Code of Criminal Procedure.
Promulgated in March 2020 and published on June 24, 2020, these codes were initially scheduled to come into force 24 months after their publication, i.e. on June 24, 2022. However, due to significant protest movements, the government of Ariel Henry had already postponed their implementation in 2024.
These legal texts had sparked lively debates and mobilizations within Haitian society as soon as they were published by the government of Jovenel Moïse. Several civil society organizations had strongly criticized certain articles, questioning their morality.
The new codes are intended to replace those in force since 1836, which no longer reflect developments in Haitian society after nearly two centuries of application.
