The RNDDH demands the dismissal of Commissioner Muscadin and the opening of an investigation into the ex-CG Guillaume

The National Human Rights Defense Network (RNDDH) reports serious facts attributed to magistrate Jean Ernest Muscadin, justifying his dismissal rather than a simple reprimand. Concerning magistrate Elder Guillaume, recently replaced at the Prosecutor’s Office near the Court of First Instance of Port-au-Prince by Me Lionel Constant Bourgoin, the human rights organization calls for an investigation into his unethical behavior.

This Monday, July 1, 2024, the RNDDH reactivates two correspondences sent in 2023 to the Minister of Justice at the time, Emmelie Prophète Milcé, relating to the dismissal of the government commissioner at the Court of First Instance of Miragoane, Jean Ernest Muscadin, and to an investigation into the unethical behavior of the former head of the Port-au-Prince jurisdiction, magistrate Elder Guillaume.

In an open letter, the RNDDH refers to the case between citizen Marc-André Dériphonse and journalist Banatte Daniel, which led to events involving the beating of political activist Rébert Noncent “D-zine” by police officers, on the orders of magistrate Elder Guillaume. The intervention of the police, ordered by the head of the Prosecutor’s Office, took place while the political activist was holding a press conference in front of the Prosecutor’s Office in Port-au-Prince. In view of these facts, the RNDDH considers the behavior of magistrate Elder Guillaume, who violated Rébert Noncent’s rights to physical and psychological integrity as well as his freedom of expression, enshrined in Articles 5 and 13 of the American Convention on Human Rights, ratified by Haiti, to be inconceivable.

In addition, the RNDDH recalls the incident that occurred on December 13, 2023, when the commissioner at the Court of First Instance of Miragoane, Jean Ernest Muscadin, was implicated in a scandal related to an alleged operation aimed at the arrest of Béliose Louis-Jeune “Boutba” in the jurisdiction of Les Cayes. In this context, the RNDDH notes a publicized standoff between Commissioner Jean Ernest Muscadin and the head of the Les Cayes Public Prosecutor’s Office, Ronald Richemond, regarding the presence or absence of Boutba in Port-Salut.

Based on these facts, the RNDDH insists that Commissioner Muscadin deserves to be dismissed and not simply blamed.
