The new Government Commissioner at the Prosecutor’s Office of the Court of First Instance of Port-au-Prince, Me Lionel Constant Bourgoin, promises that his office will not be a polyclinic or even a shop.

This Monday, July 8, 2024, the dean of the Court of First Instance of Port-au-Prince, Me Bernard Saimt-Vil, proceeded before members of the Haitian judicial system to the installation of Me Lionel Constant Bourgoin as the new Commissioner of the Government of Port-au-Prince, replacing Me Jean Edler Guillaume.

During his speech, Mr. Bourgoin promised that his prosecution will always be at the crossroads of public order and the law. Thanking the Minister of Justice and Public Security, Mr. Carlos Hercules for having chosen him as Commissioner of the Government of Port-au-Prince, Mr. Lionel Constant Bourgoin said he was aware of the heavy responsibility that fell to him and the high level of performance that the holder of the MJSP as well as Prime Minister Garry Conille expect from him.

Addressing the Departmental Director of the WEST 1 Police (DDO 1), the Divisional Commissioner, responsible for the Criminal Affairs Bureau (BAC) and the Commissioner responsible for the Anti-Gang Tactical Unit (UTAG), Me Bourgoin emphasizes that it is clear that in the majority of cases, investigations are deficient and only lead to results other than impunity and the violation of the freedoms of the accused or victims.

“Whenever possible, in order to facilitate the effective management of the initiation of public action, I expect that your judicial police services of the Department, the main actors in the investigation: react in real time and immediately inform the Public Prosecutor’s Office of all crimes and offences committed within the jurisdiction of the court; and execute any instructions for continuing the investigation, qualifying the offences and finally presenting the prosecution” underlines the head of the Public Prosecutor’s Office of Port-au-Prince Public Prosecutor’s Office.

As for the Deputy Commissioners, Mr Bourgoin appeals to them to respect the duties of their status as standing magistrates to act together and constantly in the name of Society with full responsibility and ethics in compliance with the operating principles of the public prosecutor’s office in order to restore confidence in litigants in general and in professionals of Justice in the jurisdiction.

He said he was counting on the Justices of the Peace of the Port-au-Prince Jurisdiction, on their involvement in initiating public action to help the prosecution respect police deadlines and refer the matter to the trial court on time. “You are, without a doubt, an important link in the chain to ensure not only the efficiency of investigations and the effectiveness of criminal justice but also peace in your jurisdiction,” he insisted.

In addition, Lionel Constant Bourgoin assures the Lawyers of the Bar that the magistrates of his prosecution will not be their obligatory partners in the handling of their cases, but will apply the Law with complete impartiality to provide a response adapted to the seriousness of the actions and to each human situation. In this sense, he specifies that his prosecution will not be a polyclinic or even a shop, while inviting them to exercise their noble profession as good auxiliaries of justice and to establish good professional relationships in all responsibility with the prosecution of Port-au-Prince.
