Investigating judge Walther Wesser Voltaire issued his order in the case of the assassination of former president Jovenel Moïse.
The 122-page document, a copy of which AyiboPost exclusively obtained, does not reveal important new information in the case. For example, it does not make it possible to clearly identify the intellectual authors of the assassination.
The order of Judge Walther Wesser Voltaire refers the names before the Criminal Court: Martine Moïse, wife of the deceased, Félix Badio, Léon Charles, former police chief and Dimitri Hérard, former commander of the General Security Unit of the Palace National, to be tried for their complicity in the assassination of ex-president Jovenel Moïse, which occurred on July 7, 2021.
The decision sends around fifty people before the criminal court without jury assistance.
If the Port-au-Prince prosecutor’s office files an appeal within the time limit provided by law, the entire order will be called into question before the higher court.
If some defendants appeal, the order will be suspended until the Court of Appeals decides on the defendants referred to the criminal court. The accused benefiting from a dismissal of the charges may be released in the meantime.
The order underlines the cessation of the prosecution against individuals already in the hands of American justice, by virtue of the principle “non bis in idem”: “No one can be prosecuted or punished criminally for the same facts”. They are, among others: John Joël Joseph, James Solage, Joseph Vincent, Roodolph JAAR, Angel Pretel Ortiz, Mario Antonio Palacios, Walter Veintemilla, Antonio Intriago and German Alejandro Rivera Garcia.
“It is not a perfect instruction, but the judge did his best,” analyzes AyiboPost, the source directly involved in the case. The Directorate of Economic and Financial Affairs of the Central Directorate of the Judicial Police was not up to the task of tracking down those who financed the coup. This failure represents the weakness of the instruction. »
